It was determined that the 10 month old was already brain dead when the paramedics brought her to the hospital. It seems that she had a severe skull fracture. It was not bad enough that she was raped. Benjamin Taylor beat the infant also. The family agreed to have her removed from life support several days later upon the advice of Dr.'s.
The courts found Benjamin Taylor guilty of rape and murder. They added a "show no mercy clause" to the judgment. That means no parole. West Virginia is a no death penalty state. There is quiet a quandary about his sentence.
I say it is very simple. West Virginia is cash "strapped" at different times. This convict will serve out time in prison. He should not be put in segregation because of his crime. Care of segregated prisoners cost the state extra money. He should go into the general population of whatever prison he is put into. There he will serve out his sentence in a most uncomfortable state as long as he continues to breath.
